Based on resolver’s experience to date, you may have been mis-sold if your contract is not the same as what was agreed with the sales person.

You should make a formal complaint to your TV provider’s customer services department. You should ask them to honour the contract as agreed with the sales person. If they do not agree to do this, report the company to the Office of Fair Trading. Any contract term, which states the company does not uphold statements by sales staff is deemed an unfair term. Any false statement made by a sales person in order to secure your business is deemed a misrepresentation (even if your provider has a term in their contract which purports to prevent their salesperson binding them to different terms). Under such circumstances, you are within your rights to cancel the contract with no cancellation charges. You also may be able to take legal action for compensation for any payments you have already made. False statement to secure contract is a criminal offence. Trading Standards should be informed of any such practices.

If you cannot resolve your issue you cannot raise your case to the Ombudsman until 8 weeks after you have first raised your complaint with your supplier, or you have received a ‘letter of deadlock’ from the company stating that they cannot resolve the issue as you have asked. Your complaint must also not be older than 9 months. For an accurate decision by the Ombudsman you should provide a detailed file of your communications and supporting documentation. In addition make sure you explain what you want as an outcome as this will help assess your case.
