Making a complaint to Barclays Bank with Resolver

Barclays packaged bank account mis-selling 

The main service for complaints about mis-selling is packaged bank accounts, which for Barclays included Current Account Plus, Additions Active, Graduate Additions, Premier Life, First Additions and Additions Plus. These were sold as an account that provided a number of value-added benefits. These benefits may or may not have been suitable to the consumer to whom they were sold. Barclays can help you if you are unsure about the type of account you had. Not all packaged bank accounts were mis-sold and not all packaged bank accounts are inappropriate. However, if you were sold a Barclays packaged bank account and you believe you may have been mis-sold, you are entitled to make a claim. 

You can make a complaint to Barclays Bank through resolver. Ensure that the email contains the phrase 'this is an official complaint'. This way, Barclays Bank must investigate your complaint based on the regulated terms defined by the Financial Conduct Authority and it also means that after 8 weeks your complaint can be sent on to the Financial Ombudsman Service for independent assessment and a decision, which is binding on the company, even if Barclays rejects your claim.

Barclays Complaints

Barclays Packaged Bank Account claims can be referred to the Financial Ombudsman Service if you are unhappy or disagree with their response to your complaint. A referral to the Financial Ombudsman may not necessarily increase your chances of your Packaged Bank Account claim being found in your favour. This is because Packaged Bank Account mis-sale complaints are very different from Payment Protection Insurance (PPI) complaints; for example just because you have not used a feature on the account does not mean that the Packaged Bank Account was mis-sold to you. If your complaint cannot be resolved

In order to refer a complaint to the Financial Ombudsman Service, you must meet the Financial Ombudsman Service eligibility criteria. The Financial Ombudsman Service will consider complaints from:

  • a private individual
  • a small business which has an annual turnover, and/or balance sheet, of up to 2 million euros and fewer than 10 staff (micro enterprise)
  • a charity which has an annual income of less than £1million
  • a trustee of a trust which has a net asset value of less than £1million.

After 8 weeks, if your complaint with Barclays cannot be resolved, then you can escalate your case to the Financial Ombudsman Service. Barclays is required to follow any recommendations the Financial Ombudsman Service provides. It will look at your case from the perspective of what is reasonable and fair. The Ombudsman's role is to undertake an independent assessment that is free to you and means, whatever decision it makes about your complaint, if you chose to accept it, then Barclays has to accept it as well. 

Barclays Banking Complaints Compensation 

If you are awarded compensation then you will also receive interest. Your refund of the premiums and the interest you paid is not taxable. You are, however, required to pay income tax on the 8% statutory compensation payment. In line with current UK legislation Barclays will have deducted income tax at the current basic rate of 20% from the 8% statutory compensation payment. If you are entitled to claim back the income tax you will need to contact HM Revenue & Customs (HMRC) directly and complete an R40 claim form. If you do not complete a tax return or you need to pay income tax at the higher or additional rate you will need to contact HMRC. Any further tax liability as a result of this payment will be your responsibility.
